Tax-Free Property Package for Overseas Pakistanis: What’s Coming

What the government is proposing for overseas investors

Pakistan’s federal government is preparing a tax-free real estate investment package aimed at overseas Pakistanis, according to official sources. The proposal has reportedly been shared with the International Monetary Fund (IMF) for approval, and officials expect it could be formally introduced as early as next month.

The idea is being framed as a way to attract foreign inflows, particularly in dollars, at a time when Pakistan remains under pressure to strengthen foreign exchange reserves and stimulate economic activity. Real estate is one of the largest and most active sectors in the country, but overseas buyers often avoid it due to paperwork, weak enforcement, and fraud concerns.

If implemented, the package would try to make property investment safer, simpler, and more transparent for overseas Pakistanis who want exposure to Pakistan’s housing and construction market but do not want the risk that usually comes with informal dealing and disputed titles. The “tax-free” positioning is also meant to make the offer attractive compared with other investment options competing for diaspora money.

Why escrow accounts are central to the plan

One of the biggest mechanisms under consideration is the use of escrow accounts. In plain words, an escrow account is a controlled account where money is held safely until agreed conditions are met. For example, a buyer’s payment can remain in escrow until documents are verified, transfer is confirmed, or a development milestone is completed.

In Pakistan’s property market, escrow could be a major change because many fraud cases happen when money is paid directly to a seller, agent, or developer without strong safeguards. If escrow becomes a standard part of transactions under this package, it could reduce common risks such as fake files, delayed possession, double-selling, and disputes over ownership.

Escrow also increases transparency. It creates a formal record of where the money is, when it was released, and on what basis. For overseas Pakistanis who cannot physically manage every step, that structure can improve confidence and reduce dependence on informal “trusted contacts” or middlemen.

However, the impact will depend on how escrow is governed. Investors will want clarity on who operates the escrow system, what happens if there is a dispute, and whether the framework is enforceable across provinces and different development authorities.

REITs and special zones: a shift toward structured investing

Another major element being discussed is the development of Real Estate Investment Trusts (REITs). A REIT is a regulated structure that lets investors put money into real estate projects or income-generating property through a managed vehicle, rather than buying a plot or apartment directly.

For overseas Pakistanis, REITs could provide a cleaner route into the sector because they typically offer professional management, reporting, and clearer compliance standards. Instead of worrying about dealing with agents or verifying paperwork personally, an investor could buy into a structured investment channel.

Officials are also evaluating special investment zones to promote construction and large-scale development. The purpose is to concentrate activity where rules, approvals, and infrastructure support are clearer. If the zones come with predictable regulations and faster processing, they could reduce delays that often frustrate investors and developers.

In combination, REITs and special zones signal a broader shift: moving away from purely informal, file-based speculation toward more regulated and investment-grade channels. That can support construction activity, create jobs, and help the government present real estate as a credible destination for diaspora capital.

Tax incentives, IMF approval, and the filer vs non-filer divide

The most sensitive part of the package is taxation. Officials say adjustments to taxes on property transactions are proposed, but these changes are awaiting IMF approval. That matters because Pakistan’s fiscal commitments under IMF programmes often limit how much tax relief the government can offer, especially if it reduces revenue or creates loopholes.

The package is expected to offer additional incentives and facilities specifically to overseas Pakistanis, but with an important condition: benefits may largely be limited to tax filers. This is consistent with Pakistan’s wider tax policy direction, where filers are rewarded and non-filers face higher rates and fewer concessions.

For overseas investors, the filer requirement is not just a technical detail. It will decide who qualifies for the “tax-free” promise and how easy it is to access. Some overseas Pakistanis already maintain filer status in Pakistan, while others do not because they live abroad and do not see the benefit. If the package is structured mainly for filers, many may need to regularise their tax status first.

Practically, investors should watch for the final rules on:
• Which taxes will be waived or reduced (withholding, capital gains, stamp duties, or others)
• Whether tax-free treatment applies to purchase, sale, rental income, or only certain transactions
• How overseas status will be verified and what documentation will be required
• Whether the package applies nationwide or only in selected projects and zones

Until the IMF gives a green signal, the government may continue to refine the plan. That means the headline may stay the same, but the exact benefits could shift once the final fiscal impact is assessed.
